Product: Car Budget Guard (the “Service”)
Provider: Car Budget Guard (“Car Budget Guard”, “we”, “us”, or “our”)
These Terms of Use (the “Terms”) govern your access to and use of the Service, including the Car Budget Guard website, calculator, and personalized car affordability and ownership reports.
1. Acceptance of Terms
By accessing or using the Service, including visiting our website, using the calculator, or purchasing and downloading any report, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service.
You represent and warrant that:
- You are at least 18 years old; and
- You have the authority to enter into these Terms on your own behalf or on behalf of the organization you represent, and to bind that organization to these Terms.
If you use the Service on behalf of an organization, “you” and “your” include both you individually and that organization.
2. Eligibility
2.1 Minimum age
The Service is intended only for users who are 18 years of age or older. The Service may not be used by anyone under 18. We do not knowingly collect information from anyone under 18. If we become aware that a user is under 18, we may terminate their access and delete associated personal data where appropriate.
2.2 Territorial scope
The Service is primarily intended for users located in Canada or the United States. By using the Service, you represent that you are legally permitted to do so in your jurisdiction.
2.3 Compliance with law
You may use the Service only if you:
- Are not subject to any embargo, sanction, or similar restriction that would prohibit your use of the Service; and
- Comply with all applicable laws, rules, and regulations in connection with your use of the Service.
3. Account Registration & Security
3.1 No user accounts at launch
At this time, the Service does not require or provide persistent user accounts. You may access the calculator and purchase reports via guest checkout without creating a login.
3.2 Checkout information
To complete a purchase, you may be required to provide certain information (such as an email address for delivery and billing details handled by our payment processor). You agree that all information you provide is accurate, current, and complete.
3.3 Future accounts
If we introduce user accounts in the future (for example, to store past reports or scenarios), we may require you to create a password or use another authentication method. In that case:
- You will be responsible for maintaining the confidentiality of your login credentials; and
- You will be responsible for all activities that occur under your account.
3.4 Device and access security
You are responsible for securing the devices and connections you use to access the Service and for preventing unauthorized use of any downloads or reports you obtain.
4. Subscription, Billing & Payment Terms
4.1 Pricing model
The Service currently offers car affordability and ownership reports on a one-time purchase basis. There are no recurring subscriptions or auto-renewals at this time.
4.2 Price and currency
- The base price for a standard report is 4.99 USD (or an equivalent amount in other currencies at the time of payment).
- For users in the United States, pricing is displayed and charged in USD.
- For users in Canada, we may display pricing in CAD as an approximate equivalent, and the actual charge may be processed in USD or CAD depending on the payment provider and your card issuer.
- Your bank, card issuer, or payment provider may apply currency conversion rates and fees.
We may change prices for future purchases at any time. Price changes do not affect purchases that have already been completed.
4.3 Taxes
Prices are exclusive of applicable sales, use, goods and services, value-added, or similar taxes. Any applicable taxes will be calculated and shown at checkout and collected in addition to the base price.
4.4 Payment processing
Payments are processed by third-party payment processor(s), including Stripe (“Payment Processor”). You authorize the Payment Processor to charge the payment method you provide for the total amount shown at checkout (including taxes and any fees).
Car Budget Guard does not receive or store your full payment card number. Card details are handled directly by the Payment Processor in accordance with their security standards and terms.
Your use of the Payment Processor’s services may be subject to their own terms and privacy policy, which you are responsible for reviewing.
4.5 Delivery of reports
After a successful payment:
- You will be provided with a download link and/or emailed a link to access your report; and
- You are responsible for downloading and securely storing any report you purchase.
We do not guarantee ongoing hosting or server-side storage of your specific report for later retrieval.
4.6 Refund policy
All sales are final.
Except where we are required to provide a refund under applicable law, we do not offer refunds or credits for:
- Change of mind;
- Dissatisfaction with assumptions or outputs where the Service is functioning as designed; or
- Failure to download or store the report after delivery, where we have made the report available.
If a technical error on our side prevents delivery of a report after successful payment, we may, at our discretion, re-attempt delivery.
4.7 Chargebacks and disputes
If you initiate a chargeback or payment dispute, you remain responsible for the underlying payment. We reserve the right to suspend or block access to the Service for users involved in fraudulent or abusive chargebacks.
5. User Obligations & Acceptable Use Policy
You agree to:
- Use the Service only for lawful purposes and in accordance with these Terms.
- Provide accurate and complete information when using the calculator and completing purchases.
- Use the outputs, including reports and affordability estimates, only for your own internal, informational purposes or for the internal purposes of the organization you represent.
- Evaluate the outputs critically and not rely on them as a substitute for professional financial, legal, tax, or other advice.
- Comply with all applicable laws, including consumer protection, anti-money-laundering, sanctions, and data protection laws.
If you use the Service on behalf of clients (for example, as a financial coach or consultant), you must ensure that:
- You have obtained all necessary consents from those clients; and
- You clearly explain to your clients that the Service provides informational tools only and is not formal financial or lending advice.
6. Prohibited Activities
You must not, and must not permit any third party to:
6.1 Unlawful or abusive use
- Use the Service for any unlawful, fraudulent, harmful, or abusive purpose.
- Harass, threaten, defame, or otherwise harm others through or in connection with the Service.
- Use the Service to support, enable, or conceal fraud, money laundering, sanctions evasion, or other prohibited conduct.
6.2 Security and integrity
- Attempt to gain unauthorized access to the Service, other users’ data, or any related systems or networks.
- Probe, scan, or test the vulnerability of the Service or any connected system or network.
- Interfere with or disrupt the operation of the Service (including via denial-of-service or distributed denial-of-service (DDoS) attacks, botnets, or automated traffic).
- Bypass or attempt to bypass any rate limits, access controls, or technical restrictions we apply.
6.3 Resale and commercial misuse
- Resell, redistribute, sublicense, or otherwise commercially exploit reports or outputs from the Service, except for internal use by your organization.
- Use the Service at scale to provide a product or service that competes with Car Budget Guard, without our prior written consent.
- Use the reports as a formal basis for credit underwriting, loan approval, regulatory risk assessment, or similar regulated activities, unless you have a separate written agreement with us that expressly permits such use.
6.4 Scraping, copying, and reverse engineering
- Scrape, harvest, or extract data from the Service using bots, crawlers, or other automated methods, except as permitted by a separate written agreement.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service, except to the limited extent that applicable law expressly permits despite this restriction.
- Copy, modify, adapt, or create derivative works of any part of the Service (including the report templates, content, and styling), except as expressly allowed under these Terms.
6.5 Misrepresentation and misuse of outputs
- Represent any output of the Service as coming directly from a bank, lender, regulator, or other financial institution.
- Present the outputs as guaranteed, official, or comprehensive financial advice.
- Use the Service or its outputs to mislead third parties, including in marketing, loan applications, or financial disclosures.
If you breach this section, we may suspend or terminate your access to the Service and pursue any other remedies available to us.
7. Intellectual Property Rights
7.1 Ownership of the Service
All rights, title, and interest in and to the Service, including the website, software, calculators, algorithms, report templates, text, graphics, logos, trademarks, and other content (collectively, the “Car Budget Guard Content”) are and will remain the exclusive property of Car Budget Guard and its licensors.
Except for the limited rights expressly granted in these Terms, no rights are granted to you in or to the Car Budget Guard Content or the Service, whether by implication, estoppel, or otherwise.
7.2 License to use the Service and reports
Subject to your compliance with these Terms and payment of all applicable fees, Car Budget Guard grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to:
- Access and use the Service for your own personal, household, or internal business purposes; and
- Download, store, and use reports you purchase for your own internal purposes (or, where you act on behalf of an organization, for that organization’s internal purposes).
You may not:
- Share or distribute reports publicly;
- Sell or resell reports to third parties; or
- Use reports as the core of a commercial product or service without our prior written consent.
7.3 Feedback
If you provide feedback, comments, ideas, or suggestions about the Service (“Feedback”), you agree that we may use, copy, modify, and incorporate that Feedback without restriction and without any obligation or compensation to you.
8. User-Generated Content
8.1 Structured inputs
When you use the calculator or purchase a report, you provide structured inputs such as income, expenses, savings, driving habits, and other financial or usage details (“Input Data”).
You retain any rights you may have in your Input Data. However, you grant Car Budget Guard a worldwide, non-exclusive, royalty-free license to:
- Use, process, store, analyze, and reproduce the Input Data to generate reports and operate, maintain, and improve the Service; and
- Use the Input Data in de-identified and/or aggregated form for analytics, benchmarking, and business intelligence purposes.
We do not use your Input Data in a way that would identify you personally in public materials without your consent.
8.2 Other content (e.g., feedback, reviews)
If, now or in the future, you submit free-form content such as reviews, testimonials, or comments (“User Content”), you grant Car Budget Guard a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such User Content in connection with the Service and our business, including for marketing and promotional purposes.
You represent and warrant that:
- You have all necessary rights to submit the Input Data and User Content; and
- The Input Data and User Content do not infringe any third-party rights, including privacy, publicity, or intellectual property rights, and do not violate any law.
8.3 Responsibility for content
You are solely responsible for your Input Data and User Content. We are not obligated to monitor or review any content but may remove or restrict access to content that we believe violates these Terms or applicable law.
9. Third-Party Services & Integrations
The Service may rely on or integrate with third-party services, including but not limited to:
- Payment processors (e.g., Stripe);
- Analytics providers (e.g., Google Analytics); and
- Hosting and infrastructure providers (e.g., AWS).
These third parties are independent of Car Budget Guard and may have their own terms of service and privacy policies. Your use of such third-party services is governed by those third-party terms, not by these Terms.
Car Budget Guard is not responsible for:
- The availability, accuracy, or performance of third-party services; or
- Any loss or damage arising from your use of third-party services.
10. Data Privacy & Security
10.1 Privacy Policy

By using the Service, you consent to our collection, use, and disclosure of personal data as described in the Privacy Policy.
10.2 Data retention and anonymization
We may store Input Data and technical information (such as device characteristics, browser type, and usage data) in order to:
- Generate reports;
- Operate and secure the Service; and
- Perform analytics and product improvements.
We may retain and use Input Data in anonymized and/or aggregated form so that it can no longer reasonably be linked to an identified or identifiable individual. We may use such anonymized and aggregated data for analytics, benchmarking, and other business purposes.
10.3 Security
We implement technical and organizational measures designed to protect the security of the Service. However, no system is perfectly secure. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your data.
You are responsible for:
- Protecting your devices and network; and
- Keeping any downloaded reports and related information secure.
10.4 Communications
By providing your email address, you agree that we may send you:
- Transactional messages related to your use of the Service (e.g., receipts, report delivery, technical notices); and
- Service-related updates and, where permitted, marketing communications.
You can opt out of marketing emails by using the unsubscribe link in those messages. You cannot opt out of essential transactional emails while you continue to use the Service.
10.5 Compliance intentions
We aim to comply with applicable data protection laws in the jurisdictions where we operate and where we target our services. Our Privacy Policy provides further details on how we handle personal data.
11. Service Availability & Disclaimers
11.1 No guarantee of availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee that:
- The Service will be uninterrupted, timely, secure, or error-free; or
- Any defects or inaccuracies will be corrected.
We may modify, suspend, or discontinue any part of the Service (including features, report formats, and assumptions) at any time, with or without notice, and without liability to you, provided that this does not affect reports you have already purchased other than as explicitly permitted by law or these Terms.
11.2 Informational nature; no financial advice
The Service provides tools and reports for informational and educational purposes only. It does not:
- Provide financial, investment, tax, legal, or accounting advice;
- Assess your overall creditworthiness or suitability for any specific financial product; or
- Replace professional advice from qualified advisors.
Car Budget Guard is not a bank, lender, credit bureau, mortgage broker, or financial planner. The Service does not provide loan approval, credit decisions, or binding lending recommendations.
You are solely responsible for:
- Evaluating any outputs of the Service; and
- Making your own financial and purchasing decisions, including whether to buy, lease, finance, or not purchase a vehicle.
You should consult qualified professional advisers before making significant financial decisions.
11.3 Assumptions and estimates
The Service relies on:
- Your Input Data, which may be incomplete or inaccurate; and
- Assumptions, models, and external factors (e.g., interest rates, insurance costs, fuel prices, taxes, maintenance costs), which may change over time and may not reflect your particular circumstances.
We do not guarantee:
- The accuracy, completeness, or timeliness of any estimates, projections, or recommendations; or
- Any specific financial outcome, affordability result, or performance of any vehicle or financing option.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
12.1 Exclusion of certain damages
Car Budget Guard and its officers, directors, employees, contractors, and suppliers will not be liable for any:
- Indirect, incidental, consequential, special, punitive, or exemplary damages;
- Loss of profits, savings, revenue, data, or business opportunities; or
- Business interruption or reputational harm,
arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
12.2 Overall liability cap
In any case, Car Budget Guard’s total aggregate liability arising out of or relating to the Service or these Terms, whether in contract, tort (including negligence), strict liability, or otherwise, is limited to the total fees you paid to Car Budget Guard for the Service in the three (3) months immediately preceding the event giving rise to the claim.
12.3 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such cases, the exclusions and limitations above apply only to the extent permitted by applicable law.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Car Budget Guard and its officers, directors, employees, contractors, and suppliers from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service, reports, or outputs in violation of these Terms or any applicable law.
- Any Input Data or User Content you provide that:
- Infringes or misappropriates any intellectual property, privacy, publicity, or other rights of any person;
- Is defamatory, misleading, or otherwise unlawful.
- Your use of the Service to:
- Conduct or facilitate fraud, scams, or other illegal activities;
- Launch, support, or enable DDoS or similar attacks, botnets, or abusive automated traffic;
- Circumvent technical, security, or usage limits; or
- Evade sanctions or law enforcement.
- Your misuse of the Service or outputs in jurisdictions or contexts for which we have not warranted compliance with specific regulatory or licensing requirements (for example, using the outputs for regulated credit underwriting or lending decisions without a separate agreement with us).
- Any third-party claim, investigation, regulatory inquiry, or enforcement action arising from:
- Your spam, abuse, scraping, harassment, or other prohibited behavior; or
- Your failure to implement basic security practices (e.g., leaking access credentials, sharing downloads improperly).
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with our defense.
14. Termination
14.1 Suspension or termination by Car Budget Guard
We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if:
- We reasonably believe you have violated these Terms or any applicable law;
- We suspect fraud, abuse, security risk, or technical harm; or
- We discontinue the Service or any portion thereof.
14.2 Effect of termination
Upon termination:
- Your right to access and use the Service will cease immediately;
- You will remain responsible for all fees incurred prior to termination; and
- Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
Termination does not automatically invalidate any copies of reports you have already lawfully downloaded. You may continue to use those copies solely for your internal purposes and only in accordance with these Terms.
14.3 User-initiated cessation and data handling
If you choose to stop using the Service, you may request that we delete or anonymize personal data associated with you, subject to:
- Our legitimate business needs (e.g., maintaining transaction records); and
- Our legal obligations (e.g., tax, accounting, and regulatory recordkeeping).
We may retain Input Data and other information in anonymized and/or aggregated form after de-identification.
15. Governing Law
These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any conflict of laws principles.
You and Car Budget Guard agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada, for the resolution of any such disputes, subject to any mandatory jurisdiction rules that apply under applicable law.
16. Limitation Period for Claims
To the maximum extent permitted by law, any claim or cause of action arising out of or related to these Terms or your use of the Service must be filed within one (1) month after the claim or cause of action arose. If it is not filed within that period, the claim or cause of action is permanently barred.
17. Changes to the Terms
We may update these Terms from time to time. When we do:
- We will update the “Effective Date” at the top of these Terms; and
- Where reasonably practicable, we will notify you of material changes via email sent to the address associated with your most recent purchase or interaction.
By continuing to access or use the Service after updated Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
